By accessing, browsing, or using Peluka Gaming Network ("PGN", "we", "us", "our"), including any software, services, features, or content offered through the PGN platform, you ("user", "you", "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms").

If you do not agree with any part of these Terms, you must not use PGN. Your continued use of the platform after any modifications to these Terms constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and Peluka Gaming Network. They govern your access to and use of all PGN services, including but not limited to the game lobby, matchmaking, rankings, chat, forums, and any associated tools or APIs.

Peluka Gaming Network is an online gaming platform that provides the following services:

• Game Lobby: Virtual rooms where players can meet, organize matches, and communicate before, during, and after games.
• Matchmaking: Automated systems to pair players of similar skill levels for fair and competitive gameplay.
• Board Games: Built-in board game implementations playable directly through the PGN platform.
• Mods and Patches: A repository for user-created modifications, patches, and custom content that enhance supported games.
• Rankings and Statistics: ELO-based rating systems, leaderboards, match history, and detailed player statistics.
• NAT Traversal: Connectivity services that enable peer-to-peer connections between players behind firewalls and NAT routers.
• Community Features: Chat, private messaging, forums, clans, and social features to foster the gaming community.

Important: PGN is a connectivity and community platform. PGN does NOT distribute, sell, license, or provide copies of any video games. PGN is not a game store, game publisher, or game distributor.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

Account requirements and responsibilities include:

• One account per person: Each individual may register and maintain only one PGN account. Creating multiple accounts ("smurfing") is prohibited and may result in all associated accounts being permanently banned.
• Email verification: You must verify your email address during registration. Accounts with unverified email addresses will have limited access to PGN features until verification is completed.
• Accurate information: You must provide accurate and current information during registration. Providing false identity information is grounds for account termination.
• Account security: You are solely responsible for keeping your password secure. We recommend using a strong, unique password that you do not use on other platforms.
• Non-transferable: Accounts are personal and non-transferable. You may not sell, trade, give away, or otherwise transfer your account to another person.

PGN is not liable for any loss or damage arising from your failure to protect your login credentials or from unauthorized access to your account.

You must be at least 13 years of age to create an account and use PGN services. This requirement is in compliance with the Children's Online Privacy Protection Act (COPPA) and similar regulations.

By creating an account, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

If we discover or have reason to believe that an account belongs to a person under the age of 13, we will terminate that account immediately and delete all associated personal data without prior notice.

Peluka Gaming Network is a matchmaking, connectivity, and community platform. PGN does not distribute, host, sell, or provide copies of any video games.

To play games through PGN, you must own a legitimate, legally obtained copy of the game. This includes games purchased through official retailers, digital stores, or other authorized distribution channels.

PGN provides only the following in relation to games:

• Connectivity: Peer-to-peer networking, NAT traversal, and lobby infrastructure to enable multiplayer sessions.
• Mods and Patches: User-created modifications, balance patches, and custom content uploaded by the community.
• Rankings: ELO ratings, leaderboards, match statistics, and competitive tracking.
• Community: Chat, forums, clans, and social features around supported games.

PGN does not verify game ownership and operates under the assumption that all users are using legally obtained copies. Any use of pirated, cracked, or otherwise illegitimate copies of games through PGN is solely the user's responsibility and constitutes a violation of these Terms.

When using PGN services, you agree to conduct yourself in a manner that is respectful, fair, and in accordance with the spirit of competitive gaming. The following activities are strictly prohibited:

• Cheating: Using cheats, hacks, trainers, memory editors, or any form of software that provides an unfair advantage in games played through PGN.
• Exploiting: Intentionally exploiting bugs, glitches, or vulnerabilities in PGN or in games played through PGN. If you discover a bug, report it — do not exploit it.
• Hacking: Attempting to gain unauthorized access to PGN systems, other users' accounts, or any infrastructure connected to PGN services.
• Harassment: Bullying, threatening, intimidating, stalking, or otherwise harassing other users in any PGN channel, including lobbies, chat, forums, or private messages.
• Hate Speech: Promoting violence, discrimination, or hatred against individuals or groups based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
• Spam: Flooding chat, lobbies, forums, or any communication channel with repetitive, unsolicited, or irrelevant messages.
• Impersonation: Pretending to be another user, a moderator, a PGN staff member, or any other person or entity.
• DDoS and Network Attacks: Launching or facilitating denial-of-service attacks, packet flooding, or any form of network attack against PGN infrastructure, game servers, or other users.
• Abuse of Systems: Manipulating rankings, match results, or any PGN system through collusion, match-fixing, win-trading, or other deceptive practices.
• Illegal Activity: Using PGN services for any purpose that violates applicable local, national, or international laws or regulations.

Violation of any of these rules may result in moderation action up to and including permanent account termination, at PGN's sole discretion.

PGN provides various communication features including, but not limited to, game lobbies, public chat rooms, private messages, forums, and clan channels. When using any PGN communication service, you agree to the following:

• Do not post spam, chain messages, or unsolicited bulk communications of any kind.
• Do not advertise products, services, websites, or other platforms without prior written authorization from PGN.
• Do not share, post, or distribute illegal content, including but not limited to pirated software, copyrighted material, or content that violates any law.
• Do not post links to malware, phishing sites, scam websites, or any content designed to harm users or their systems.
• Do not share other users' personal information (doxxing) without their explicit consent.
• Do not post or share sexually explicit, pornographic, or excessively violent content.
• Keep discussions respectful and relevant to the channel or forum topic.

PGN reserves the right to monitor, moderate, and remove any content posted through its communication services. Messages sent through PGN may be logged for moderation and safety purposes.

PGN employs volunteer and staff moderators to maintain a fair, safe, and enjoyable environment for all users. Moderators have the authority to enforce these Terms and community standards.

Moderation actions follow an escalation process:

1. Warning: A formal notice that the user's behavior violates PGN rules. Warnings are recorded on the account.
2. Mute: Temporary restriction of communication privileges in chat, lobbies, or forums. Duration varies based on the severity of the offense.
3. Kick: Removal from a game lobby or chat room. The user may rejoin after being kicked.
4. Boot: Temporary suspension from PGN services for a defined period (hours, days, or weeks depending on the offense).
5. Ban: Permanent removal from PGN. Reserved for severe or repeated violations. Bans affect all associated accounts.

Severe violations — including cheating, DDoS attacks, or distribution of malicious content — may result in immediate escalation to a boot or ban, bypassing earlier steps in the process.

Appeals: If you believe a moderation action was taken in error, you may submit an appeal via email to support@peluka.info. Include your username, the date of the action, and a detailed explanation of why you believe the decision was incorrect. Appeals are reviewed by senior moderators or staff and are typically processed within 7 business days. Appeals must be submitted via email — appeals through Discord, chat, or other informal channels will not be considered.

PGN allows users to upload and share game modifications ("mods"), custom maps, data patches, and other user-created content through the platform.

By uploading content to PGN, you represent and warrant that:

• You are the creator of the content or have obtained all necessary rights and permissions to distribute it.
• The content does not infringe on any third party's intellectual property rights, including copyrights, trademarks, or patents.
• The content does not contain malware, viruses, or any other harmful code.
• The content complies with all applicable laws and these Terms of Use.

By uploading content, you grant PGN a non-exclusive, worldwide, royalty-free license to host, distribute, and display the content through the PGN platform for the purpose of providing the service. You retain ownership of your original content.

Content verification: PGN performs basic format and integrity checks on uploaded content (file format validation, size limits, virus scanning). However, PGN does not review or endorse the content of mods and is not responsible for any damage, data loss, or issues caused by user-uploaded content. Users download and install mods at their own risk.

Copyright claims: If you believe that content hosted on PGN infringes your copyright or intellectual property rights, please submit a detailed claim to legal@peluka.info including: identification of the copyrighted work, identification of the infringing material on PGN, your contact information, and a statement of good faith belief that the use is unauthorized. We will review and respond to valid claims in a timely manner.

PGN may offer premium subscription tiers that provide additional features, benefits, and enhanced access to platform services. Premium tiers are optional — core features including matchmaking, basic lobbies, rankings, and community access will always remain available at no cost.

Regarding premium subscriptions:

• Non-refundable: All premium subscription purchases are final and non-refundable, except where required by applicable law. By purchasing a premium tier, you acknowledge this policy.
• Pricing changes: PGN reserves the right to modify premium tier features and pricing at any time. Existing subscribers will be notified of pricing changes at least 30 days before they take effect for their next billing cycle.
• Cancellation: You may cancel your premium subscription at any time. Your premium benefits will remain active until the end of the current billing period.
• Account termination: If your account is terminated for a violation of these Terms, you forfeit any remaining premium subscription time and are not entitled to a refund.

Specific premium tier features and pricing will be detailed on the PGN platform when available.

PGN provides an official Application Programming Interface (API) for developers and third-party applications to access PGN data and services programmatically.

• Official API: Developers must use the official PGN API for any programmatic access to PGN data. API documentation, rate limits, and access tiers are published on the PGN developer portal.
• Scraping prohibited: Automated scraping, crawling, or harvesting of the PGN website or any PGN web interface is strictly prohibited. If you need data, use the API.
• API keys: API access requires a valid API key. Keys are personal, non-transferable, and must not be shared publicly or embedded in client-side code.
• Rate limits: All API usage is subject to rate limits based on your access tier. Exceeding rate limits may result in temporary or permanent revocation of API access.
• Fair use: API access must be used in a manner consistent with these Terms. Using the API to build competing services, perform abusive operations, or circumvent PGN platform rules is prohibited.

PGN reserves the right to modify, restrict, or discontinue API access at any time with or without notice.

Your privacy is important to us. PGN collects, processes, and stores personal data in accordance with our Privacy Policy.

By using PGN, you consent to the collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into and forms part of these Terms of Use.

The PGN platform, including its software, website, design, logos, and all associated intellectual property, is the proprietary property of Peluka Gaming Network and is protected by applicable intellectual property laws.

• PGN property: The PGN client software, server software, website, APIs, and all related documentation are proprietary. You may not reverse engineer, decompile, disassemble, or create derivative works based on PGN software without explicit written authorization.
• Game trademarks: Game names, logos, and related intellectual property referenced on PGN are trademarks of their respective owners. PGN's support for a game does not imply endorsement by or affiliation with the game's publisher or developer.
• User content: Users retain ownership of their original content uploaded to PGN, subject to the license granted in Section 9 of these Terms.

Nothing in these Terms grants you any right, title, or interest in PGN's intellectual property beyond the limited right to use the platform in accordance with these Terms.

PGN services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, PGN disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PGN does not warrant or guarantee that:

• The platform will be available at all times or operate without interruption or errors.
• Game connectivity, matchmaking, or NAT traversal will work in all network configurations.
• User-uploaded content (mods, patches, maps) will be free of defects or safe to use.
• Rankings, statistics, or match data will be perfectly accurate at all times.

PGN is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of PGN services, including but not limited to: game crashes, data loss, corrupted save files, connectivity issues, loss of rankings or statistics, or any damage caused by user-uploaded mods or patches.

You use PGN entirely at your own risk.

PGN reserves the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms of Use or for any conduct that PGN, in its sole discretion, considers harmful to the platform or its community.

• Accounts terminated for Terms violations are not entitled to any refund of premium subscription fees or any other form of compensation.
• Upon termination, your right to access PGN services ceases immediately. PGN may, at its discretion, delete account data associated with terminated accounts.
• Attempting to circumvent a ban by creating new accounts will result in the termination of all associated accounts.
• You may voluntarily close your account at any time by submitting a request to support@peluka.info.

Sections of these Terms that by their nature should survive termination (including Disclaimer, Intellectual Property, and Privacy) will remain in effect after account termination.

PGN reserves the right to update, modify, or replace these Terms of Use at any time. When we make changes, we will update the "Last updated" date at the bottom of this page and, for significant changes, we may notify users through the PGN platform or via email.

Your continued use of PGN after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using PGN and may request account deletion.
